These Terms of Use govern your use of Fabric Fisher, the Fabric Fisher web site, and all associated services (together referred to as the Services). Whenever you create a Fabric Fisher account, or use any of the Services, you agree to these Terms of Use. These Terms of Use are a legally binding agreement between you and Fabric Fisher.
1.1 In order to use the Services, you must accept these Terms of Use. You may not use the Services if you do not accept the Terms of Use.
1.2 You accept these Terms of Use simply by using the Services. You understand that Fabric Fisher will treat using the Services as acceptance of these Terms of Use from that point forward.

3.2 You will not make available or attempt to make available through the Services any material that is inappropriate in any way. For example, the Services allow you to upload photos of fabrics you are trying to match; uploading of any other photos is considered inappropriate.
3.3 You will not use or attempt to use the Services in a way as to violate any laws or regulations.
3.4 You will not impersonate or attempt to impersonate any other person or entity, or to disguise the origin of any content transmitted to or through the Services.
3.5 You will not interfere with or attempt to interfere with or disrupt the Services, or to limit their availability in any way.
Upon becoming aware of any potential violation of any of these Terms of Use, Fabric Fisher reserves the right to block your access to the Services, or to delete your account or any of your content, without prior notice and at its sole discretion.
5.1 Fabric Fisher gives you a personal license to use the software provided to you as part of the Services. This license is royalty-free, non-exclusive, and non-transferable, and is provided to you for the sole purpose of using the Services in the manner defined by these Terms of Use.
5.2 The Services are protected by copyright, trademark, and other laws of the United States and of foreign countries. These Terms of Use do not in any way give you the right to use the Fabric Fisher name, logos, or other branded material without prior written permission.
5.3 All rights, title, and interest in and to the Services and related intellectual property are the exclusive property of Fabric Fisher. Nothing in these Terms of Use transfers these rights, title, or interest to you or to any third party.
6.1 We work hard to make the Services fun and useful for everyone. However, the Services are provided to you "as is" and "as available". We make no guarantees that they will be free of defects, or that they will function without disruption, delays, or imperfections.
6.2 Much of the content available through the Services is derived from third-party web sites. We have no control over the content of these sites, and are not responsible for the accuracy of such content.
6.3 To the extent permissible by law, we disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
6.4 We cannot predict when issues will arise with the Services. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law. Under no circumstances shall we be liable to you for any lost profits, revenue, information, or data arising out of or related to the use of the Services. Nor shall we be liable to you for any consequential, special, indirect, exemplary, punitive, or incidental damages.
